Do I need to be in Montenegro to buy property?

Quick Answer:

No. Most foreign buyers use a Power of Attorney to authorize someone here—your lawyer, NT Realty, or another trusted representative—to sign on your behalf.

You do not have to be physically in Montenegro to buy property, but you do need to authorize someone who is present.  

Most foreign buyers use a notarised Power of Attorney (PoA) to authorize a lawyer, NT Realty, or another trusted representative to:

  • Sign the sale contract
  • Attend the notary meeting and sworn court translator session
  • Submit tax declarations and pay RETT
  • File documents for registration in the Real Estate Cadastre  

If the PoA is signed abroad, it usually must be notarised in your home country and then apostilled (if your country is a signatory to the Hague Apostille Convention) or otherwise legalised through consular channels. Once in Montenegro, the PoA must be translated by a sworn court translator before it can be used in the transaction.  

Some banks may still prefer or require you to appear in person to open an account or sign mortgage documents. However, the property transfer itself can be fully handled through PoA.
