Is there title insurance in Montenegro?

Quick Answer:

No, Montenegro doesn't have a title insurance system like the US or UK. Instead, buyers rely on comprehensive legal due diligence—your lawyer or notary checks the cadastre, ownership history, encumbrances, and permits before you commit. It's a different system, but with proper checks it's just as secure.

Classic US-style residential title insurance is not widely used or marketed in Montenegro.  

Instead of title insurance, risk is managed through:

  • Detailed checks of the Real Estate Cadastre extract (List nepokretnosti)
  • Verifying that the registered owner matches the seller and that there are no mortgages, liens, court disputes, or annotations
  • Confirming the legality of the building (permits, use/occupancy permit where required)
  • Checking co-ownership, servitudes, and any pre-emptive rights
  • Having a competent lawyer and notary draft, review and notarise the contract, and handle registration  

For large commercial or cross-border transactions, specialised brokers may be able to arrange bespoke title-type insurance products, but this is still the exception rather than the rule.  

For most residential buyers, good legal due diligence is the real insurance.
